What is an MCSA 5889 Form?

The MCSA-5889 form, also known as the Motor Carrier Records Change Form, is a document used by motor carriers to submit changes or updates to their records with the Federal Motor Carrier Safety Administration (FMCSA). This form allows motor carriers to change information such as their company name, address, contact details, or reinstatement of operating authority.

What happens if FMCSA 5889 is not filed?

If you don’t file MCSA 5889 form with changes, your motor carrier may be deleted. Plus, not following the rules during the update could lead to daily fines of up to $1,000, with a maximum of $10,000 overall.

When should you file a MCSA 5889 Update?

FMCSA mandates an MCSA 5889 filing when there is one or more of the following changes to your Operating Authority (MC, MX or FF):

  • Changed your business address
  • Changed your mailing address

  • Changed your company name
  • Changed your operating authority
  • Ownership Changes
  • Any Name Changes

  • Reinstatement

Whenever you make changes to your trucking business and operations that has a MC, MX or FF Number, you need to submit an MCSA-5889 form.

MCSA 5889 – Reinstatement

You MUST have an active, up-to-date USDOT# record, or include an updated MCS-150 form with your reinstatement request. If your USDOT Number is active, you may can file an MCS-150 Update here before doing a MCSA-5889.

Please note that before you request reinstatement, you must have your BOC-3 (Designation of Process Agent) form and financial responsibility/insurance filing in place. If they are not in place, your reinstatement request will be placed on hold until the BOC-3 and insurance requirements are met.

MCSA 5889 – Address Changes

When filing MCSA-5889 form for an address change you need to provide New business address and mailing address, which can be the same. You also need to provide updated phone number if applicable.

MCSA 5889 – Name Changes

When filing MCSA-5889 for Name Changes or Transfers, the procedures will depend on the changes needed. If  you are reporting a transfer of authority, you must notarize the letter provided for transfer.

If you are just changing the Legal Name such as personal, partnership, corporation or Doing Business As Name without any transfer of ownership, management or control of company; this doesn’t require much documentation.

If you are making Name changes which does not require a transfer here are acceptable reasons:

  • Hand-over to or addition/deletion of close blood relatives, i.e., child, spouse, or sibling
  • Addition of partner through marriage
  • Changes to existing corporation
  • Deletion of partner through death
  • Deletion of spouse due to divorce
  • Incorporating
  • I am an MX carrier

MCS-150 is for USDOT updates and MCSA is for Motor Carrier (Operating Authority) updates for Name Change, Address Change and Reinstatement.

If you don’t have Operating Authority (MC Number or MX Number or FF Number) you don’t have to file MCSA 5889 form for changes. You need to file a MCS-150 Update if you just have an USDOT Number.

If you have an Operating Authority (MC Number or MX Number or FF Number) and you made Address Change, Name Change or Reinstatement than you need to file both MCS-150 and MCSA-5889 Forms to update FMCSA records.
